On January 12, 1993, plaintiffs Atlantic States Legal Foundation and Don’t Waste Arizona, Inc. filed an action against the Salt River Pima-Maricopa Indian Community (SRPMIC) and the cities of Scottsdale, Mesa and Tempe under the citizen suit provisions of the Resource Conservation and Recovery Act (RCRA), 42 U.S.C. § 6972(a)(1)(A) and (B), and the Federal Water Pollution Control Act (Clean Water Act or CWA), 33 U.S.C. § 1365.
