MEMORANDUM OPINION

On July 13, 2012, this Court issued a Memorandum Opinion granting in part and denying in part defendant Ali Mo hamed Ali’s motion to dismiss the indictment. United States v. Ali, 885 F.Supp.2d 17, 2012 WL 2870263 (D.D.C.2012) (“Ali II”). 1 The Court granted Ali’s motion with regard to Count One, which alleges conspiracy to commit piracy under 18 U.S.C. §§ 1651, 371, and dismissed it for failure to state an offense.
