This case comes to us on a direct appeal from an order of the circuit court of Kankakee County which dismissed two counterclaims filed by John W. Foreman, the principal defendant, in a complaint for partition of real estate inaugurated by his former wife, Mary Foreman Frerichs. Nothing is said in the briefs of the parties concerning our jurisdiction on direct appeal, but we assume they believe that a freehold is involved.
