Affirming.

The members of the Old Yellow Creek Baptist Church have failed to heed the Biblical admonition to church members, “Be at peace among yourselves,’'’ and have appealed to the courts to settle a controversy growing out of an effort on the part of one faction of the congregation to move the church building to a new location. The building was erected more than thirty years ago on a lot near the city of Middlesboro, Ky., and in the opinion of many of the members of the congregation it has become inadequate for the purpose for which it is being used.
