Appeal, by permission, from a judgment of the Appellate Division of the Supreme Court in the third judicial department, entered December 31, 1919, unanimously affirming a judgment in favor of plaintiff entered-upon a verdict directed by the court. This action was brought by the plaintiff to recover of the defendant the sum of fifty dollars for a violation of article 11 of the Public Health Law, which regulates the practice of pharmacy in the state of New York.
