BEVILACQUA, Chief Justice.

This is an appeal from a decree of the Family Court granting the husband’s motion to modify and awarding custody of the minor children to the husband.

Walter and Dorothea Kretzer were married in Rhode Island on June 25, 1966. In January 1980 Walter initiated divorce proceedings in the State of Rhode Island. Also in 1980 the husband filed for divorce in the State of New York because Dorothea had relocated there with two of the minor children of the marriage.
