Case made from St. Joseph. (Loveridge, J.) Assumpsit. Plaintiff assigns error. The facts are stated in the opinion.

1Opinion of the CourtHooker, C. J.

This action was brought to collect village taxes upon both real and personal property. It was tried before the court without a jury, and written findings of fact and law were filed, in effect as follows:

1. The plaintiff is a corporation existing under the general laws relative to the incorporation of villages.

2. Defendant, a resident of the village, was duly assessed for taxation for the year 1892 upon real estate, the tax amounting to $145.50.

3. At the same time he was assessed upon personal property a tax amounting to $3.
