Robert Pilcher filed a petition in the probate court of Cook county, where the estate of Harry M. Higinbotham, deceased, was being administered, praying that the executors of his estate be ordered to refund to him certain moneys he had paid to them as part of the purchase price of certain lands, which the executors had sold to him, for the reason that the executors had no title to part of the lands.
