This is an action at law tried before the court with a jury. At the conclusion of plaintiff’s proofs and at the close of defendant’s proofs a motion was made for a directed verdict in favor of defendant. The court took these motions under advisement, submitted the case to the jury, and the jury returned a verdict for $3,000 in favor of the plaintiff. Defendant then filed a motion for a judgment notwithstanding the verdict. This motion was denied. Defendant also filed a motion for a new trial which was denied and judgment was entered on the verdict.
