BRUNOT, Justice.

This suit is for the purchase price of certain timber, represented by a mortgage note; for the recognition and enforcement of the lien and special mortgage securing the payment of the note, interest thereon and attorney’s fees; and, against S. H. Bolinger & Co., as eodefendant and guarantor. Waldron Lumber Company made no defense; accordingly, a judgment by default was rendered against' it. Issue was joined as to the demand upon S. H. Bolinger & Co. and the trial thereof terminated in a judgment in favor of the plaintiff and against this defendant for the sum of the note, with…
