— An unsatisfactory feature of the trial of this class of cases in an appellate tribunal is that while, of necessity, some facts and evidence must be stated in an opinion, it is not generally a reflection of the entire record, and the convictions and conclusions of the court are of necessity. based in part on evidence and facts, undisclosed by the case as reported, which *716may leave in the minds of those familiar with the record an impression that undue prominence is given to some facts, or that others are overlooked; but the difficulty is one that in practice cannot be avoided.
