This suit was begun in July, 1904, by William M. Allen, in the district court of thé city and county *545of Denver, as administrator of the estate of Thomas T. Rieno, deceased, and on July 11th next thereafter transferred to the district court of Jefferson county for trial. It is to recover an undivided one-sixth interest in the Swadley ditch, and an equal undivided share of its decreed water.
