This matter is now before the Court on the motion of the Federal Deposit Insurance Corporation (the “FDIC”), the plaintiffyntervenor in this case, to dismiss this action with *300prejudice (the “Motion to Dismiss”). The United States (the “Defendant” or the “Government”) responded to the Motion to Dismiss on August 26, 2002, indicating that it had no objection to the Motion to Dismiss and further noting that its pending Motion for Sanctions should not be affected by any dismissal of this case.
