Affirming.

Thnrlow Smith and Hubert Smith, his son, have been indicted by the grand jury of Bell county for the offense of maliciously shooting and wounding with intent to kill. The indictment in separate counts also charged Thurlow Smith with two former convictions of a felony. On separate trial Thurlow Smith has been found guilty under the various counts in the indictment and his punishment fixed at imprisonment for life. He is appealing.
