Harry G. Martin, petitioner, seeks mandamus to compel respondent to sign and enter an order extending the time of settling transcript of evidence on appeal. Petitioner as plaintiff brought suit against Richard Kearns el at. in the circuit court for the county of Washtenaw, in chancery. On May 24,1930, a decree was filed from which petitioner sought an appeal.
