Petitioner Billy Wayne Waldrop was found guilty on February 18, 1983, of the murder of Thurman Macon Donahoo under §13A-5-40(a)(2) and § 13A-5-40(a)(4), Code of Alabama 1975. The trial court, in accordance with the jury's recommendation, sentenced petitioner to the death penalty. On direct appeal, this Court affirmed petitioner's conviction in Waldrop v.State, 459 So.2d 953 (Ala.Cr.App. 1983).
