MEMORANDUM AND ORDER

SHAW, District Judge.

This matter is before the Court on defendant Planned Parenthood of the St. Louis *236Region’s motion to dismiss plaintiffs’ Amended Complaint. In the alternative, defendant moves to sever the two plaintiffs’ causes of action. Plaintiffs oppose the motion to dismiss and the alternative motion to sever. For the following reasons, the Court will deny the motion to dismiss and grant plaintiff Smith forty-five days in which to file an affidavit as required by Mo.Rev.Stat. § 538.225 (2000).
