In an action, inter alia, to recover damages for breach of an indemnification agreement, the plaintiff appeals from an order *781of the Supreme Court, Suffolk County (Emerson, J.), dated July 12, 2005, which granted the defendant’s motion for summary judgment dismissing the complaint, and denied its cross motion for partial summary judgment on the issue of liability.
Ordered that the order is affirmed, with costs.
