LAND, Justice.
Plaintiff brought this suit against the New York Life Insurance Company to recover disability benefits under a policy issued to him by that company on November 5, 1916.
The face of the policy is $10,000 and the disability benefit $1,000 per year.
The policy contains the following provisions: Whenever the. company receives due proof that the insured has become totally disabled and that such disability has then existed for not less than sixty days, one year after the anniversary of the policy next succeeding the receipt of such proof, the company will pay the insured a sum equal to…
