*603The defendant issued a policy of insurance which, among other things, insured the plaintiffs covered property against loss from fire. The policy contained a provision that an action against the defendant had to be commenced within two years of the date of loss. The plaintiffs property allegedly sustained fire damage on July 11, 1999. The plaintiff, however, failed to commence this action until July 31, 2001, by the filing of a summons with notice.
