MEMORANDUM OPINION

HILTON, District Judge.

Petitioner, Douglas Haskett (“Haskett”), a Virginia inmate proceeding pro se, filed this Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254 attacking the validity of his conviction in the Circuit Court of the City of Newport News, Virginia for rape. On December 18, 2001, respondent filed a Motion to Dismiss. Petitioner was given the opportunity to file responsive materials pursuant to Roseboro v.
