Plaintiff in error, Ralph A. Lehner, has been twice convicted and sentenced to serve indeterminate terms in the penitentiary in the circuit court of Jo Daviess county on an indictment charging him with the larceny of five hogs, of the value of $184, belonging to Christopher A. Randecker. The first trial occurred in September, 1926, and the first judgment was reversed by this court and the cause remanded to the circuit court of said county for a new trial. (People v.
