In an action to recover damages for negligence and fraud, the plaintiffs appeal from an order of the Supreme Court, Kings County (Schmidt, J.), dated September 24, 2004, which granted the motion of the defendant Eastern Savings Bank, FSB, to dismiss the complaint insofar as asserted against it pursuant to *723CPLR 3211 (a) (5) and (7), and denied their cross motion for leave to amend the complaint.
Ordered that the order is affirmed, with costs.
