Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Board of Parole revoking petitioner’s parole.

Petitioner was convicted, upon his guilty plea, of criminal possession of a controlled substance in the third and seventh degrees. After his termination from a drug court program, petitioner was sentenced as a second felony offender to the agreed-upon prison term of three years with two years of post-release supervision (hereinafter PRS).
