This case is an action in trespass brought by the owner and operator of an automobile which was involved in a collision with a street car operated by defendant company at the intersection of Center Avenue and Fullerton Street, in the City of Pittsburgh, in which accident plaintiff sustained serious personal injuries and damages to his automobile. The case was tried before a jury and resulted in a verdict for the plaintiff in the sum of $10,000. The matter is before the court upon defendant’s motion for judgment n. o. v. and for a new trial.
