Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to *533review a determination of the Commissioner of the Department of Correctional Services which sustained charges of misbehavior against petitioner.
Petitioner, an inmate at Great Meadow Correctional Facility, was charged with misbehavior based on a complaint by another inmate that petitioner had threatened and sexually assaulted him.
