Joseph Wayne Allen appeals as a matter of right from an August 15, 2007 Judgment of the Jefferson County Circuit Court convicting him of rape, sodomy, kidnapping, burglary, sexual abuse, and tampering with physical evidence. The Commonwealth alleged that on June 7, 1996, Allen brutally raped and sexually abused his then girlfriend’s thirteen-year-old daughter, N.L., in her Louisville, Kentucky home.
