W. E. Freedman, hereinafter called plaintiff, brought suit in the superior court of Pima county against George Brownell, hereinafter called defendant, for personal injuries alleged to have been sustained by the former in an automobile accident which he claimed to have occurred as the result of the negligence of defendant. The case was tried to a jury, which returned a verdict in favor of defendant.
