MEMORANDUM OPINION AND ORDER

BABCOCK, District Judge.

On June 9, 1998, the United States of America (“the government”) filed an Information charging defendant, Moon Lake Electric Association, Inc. (“Moon Lake”), with seven violations of the Bald and Golden Eagle Protection Act (“the BGEPA”), 16 U.S.C. § 668 (1997), and six violations of the Migratory Bird Treaty Act (“the MBTA”), 16 U.S.C. §§ 703 & 707(a) (1997) (collectively, “the Acts”), in connection with the deaths of 12 Golden Eagles, 4 Ferruginous Hawks, and 1 Great Horned Owl.
