An appeal was made to the Appellate Division of the Superior Court from a judgment of the Middlesex County Court dismissing the plaintiff’s action for personal injuries. Pending disposition in the Appellate Division, it has been certified on our own motion. The gravamen of the complaint is the alleged actionable negligence of the defendant.
