On August 6, 1890, the city of Chicago filed its petition in the circuit court of Cook county under the Burnt Records act against numerous defendants to establish its title, in trust for the use of the public schools, in certain land on Cottage Grove avenue between Eighty-third and Eighty-seventh streets, in Chicago. The claim of title in the original petition was based on a foreclosure by scire facias of a mortgage dated October 13, 1836, from Charles Pettit to Richard J.
