The fact situation developed by the pleadings, which are quite voluminous, is that defendant, Norman Baker, was running an institution known as the “Baker Institute”, which pur ported to cure cancer, and on April 1, 1930, plaintiff and defendant entered into a written contract which is too lengthy to be set out in full, but the substance of which, however, is that it was agreed that Baker was in possession of a secret treatment for cancer, and the sole owner of a hospital or institute called the “Baker Institute”, located in the city of Muscatine, and that plaintiff, Harry M.
