In an action to recover damages for personal injuries, the defendant appeals from so much of an order of the Supreme Court, Kings County (Patterson, J.), dated October 28, 2008, as granted that branch of the plaintiffs motion which was, in effect, to vacate the dismissal of the action pursuant to CPLR 3216 and to restore the action to the active calendar.
Ordered that the order is reversed insofar as appealed from, on the facts and in the exercise of discretion, with costs, and that branch of the plaintiffs motion which was, in effect, to vacate the dismissal of the action pursuant to CPLR…
