The action was commenced on the 1.3th day of September, 1898, to recover damages sustained by the plaintiff, alleged to have been caused by the negligence of the defendant.

*374On the 13th day of November, 1898, between five and six o’clock on the afternoon of that day, the plaintiff, who was then about eleven years of age, boarded a train of the defendant known as the -De Witt Special, as it was passing through the eastern part of the -■city of Syracuse.
