HOLCOMB, Justice.
This is an appeal from a jury verdict in which the jury found that Appellant had intentionally caused the fire that destroyed her home. St. Paul Guardianship Insurance Company, Appellee, filed an action seeking declaratory judgment to determine its liability to pay the proceeds of a fire insurance policy to its insured, Marie Blankenship. Blankenship filed a counter-claim against the Insurance Company for breach of contract for failing to pay the policy proceeds.
