MEMORANDUM OPINION

ELLIS, District Judge.

This matter is before the Court on a motion to Vacate, Set Aside or Correct Sentence under 28 U.S.C. § 2255. Petitioner, Frank Arnold Nesbitt, is currently incarcerated at the Federal Correctional Institution at Butner, North Carolina, pursuant to a guilty plea in this Court for transmitting top secret national defense infor mation to the Union of Soviet Socialist Republics (Soviet Union).
