The liability issues that arise in antitrust litigation often involve “complicated legal, factual, and technical (particularly economic) questions.” MaNüal for Complex Litigation (Fourth) § 30 (2004). But even before reaching the merits of this antitrust case involving the insurance market for veterinarians, we are faced with two difficult threshold determinations.
