This lawsuit arises out of an automobile accident in which the truck the plaintiff, Alfred Gurtner, was driving was rear-ended by a vehicle driven by Willie Pipes, defendant. Gurtner was in the course and scope of his employment at the time and was driving a truck owned by his employer, Salathe Oil Company. Gurtner and his wife filed suit against Pipes, Pipes’ lability insurer, Colonial Lloyds, and Salathe’s uninsured/underin-sured motorist (UM) insurance carrier, Ranger Insurance Company.1 Colonial Lloyds later was declared insolvent and the Louisiana Insurance Guaranty…
