DUNCAN, Justice.
This is an action upon a note originally instituted 'by H. J. Warn ell and revived by his administrator after his death and *996before trial. The trial was before a-jury, arid judgment pursuant to the verdict was rendered for $1,055, the full amount of t'he note. Upon the appeal, it is insisted that-: (1) the verdict of the jury is not supported by the evidence; (2) the co.urt .erred in, giving and refusing' instructions; .and (3) the court erred in placing the burden of proof upon the appellant.
