This action was brought by the plaintiff, who was trustee in bankruptcy of W. H. Gilbert, to set aside a conveyance by Gilbert of a stock of merchandise, which the plaintiff alleges was made in violation of the provisions *731of the bankrupt Act against fraudulent conveyances, and also in fraud of bis creditors, and which is therefore condemned both by the bankrupt law and our statutes.
