On November 29,1965 the Dutchess County Board of Supervisors, pursuant to chapter 878 of the Laws of 1965, adopted a resolution, to become effective December 1, 1965, creating the Department of Public Defender. It provided that the department should consist, among others, of an investigator who shall be a full time employee, who shall have experience as a criminal investigator or as a law enforcement officer. The Public Defender was appointed by a companion resolution and he on December 1, 1965 appointed the petitioner in this article 78 proceeding to the office of investigator and notified…
