MARTIN, Circuit Judge.

In this case, the district court dismissed the complaint of a deceased veteran's widow who brought an action to recover the proceeds of a National Service Life Insurance policy of which she was beneficiary at the time of her husband’s death.

The Veterans Administration, by letter of October 7, 1944, notified the insured of the waiver of payment of premiums by him, effective retroactively. This letter included the following language: “The Insurance Claims Counsel has rendered a decision holding that you are totally disabled and entitled to waiver of premiums effective from…
