(dissenting).—Appellant’s conviction resulted in punishment of a fine of $100 for carrying a pistol. When the case was called for trial he asked a postponement on account of the absence of his attorney. This was overruled, but a bill of exceptions was not reserved, therefore it will not be considered. The application for a continuance was overruled, but no exception reserved. The case was called for trial on the 28th of July. It was ascertained that an information had not been filed when the case was called. A complaint had been filed.
