— In an action to recover unpaid legal fees and disbursements, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Rebolini, J.), dated April 7, 2009, as denied those branches of its motion which were for summary judgment dismissing the third, fourth, and fifth affirmative defenses and granted that branch of the defendants’ cross motion which was for summary judgment on the sixth affirmative defense.

Ordered that the order is modified, on the law, by deleting the provisions thereof denying those branches of the plaintiffs motion which…
