Appeal from an order of the Supreme Court (Rumsey, J.), entered June 15, 1999 in Cortland County, which granted defendant’s motion for partial summary judgment dismissing plaintiffs Labor Law § 200 and negligence claims.
Plaintiffs employer, Paolangeli Contractors, contracted with defendant to excavate a trench on defendant’s property and, following defendant’s placement of pipe and insulation in the trench, refill it.
