MEMORANDUM OPINION

ARONOVITZ, District Judge.

This cause is now before the court on defendant Metropolitan Dade County's motion for a directed verdict.1 For the reasons that follow, the motion is due to be granted.

FACTS

Taking the evidence in the light most favorable to plaintiff Apolinar Prieto, he operates a lunch wagon in Metropolitan Dade County. For a number of years prior to February 4, 1986, Prieto would park his lunch wagon by or near the 163rd Street Shopping Mall (“the Mall”) in unincorporated Dade County for approximately 45 minutes every weekday morning and make sales to customers.…
