This action was originally brought by defendant in error, suing on behalf of himself and for the benefit of the Exchange Bank of Wewoka, Ind. T., a corporation, against plaintiffs in error as defendants. After answer was filed by defendants, the cause was referred to the master in chancery to take evidence and report bis findings of fact and conclusions of law thereon. The evidence was taken before the master on June 26, 1906; but it does not appear that any report on the facts or conclusions of law was made before the admission of the state into the Union.
