When Defendant failed to respond to Plaintiffs complaint and discovery requests, the trial court entered a default judgment in favor of Plaintiff on the issue of Defendant’s liability. The trial court set a hearing to determine Plaintiffs damages, and both Plaintiff and Defendant litigated the issue. After the trial court determined the amount of damages, Defendant asked, for the third time, the trial court to set aside the default judgment and schedule a trial on the merits.
