This was an action brought by the appellant against the respondent to obtain a decree of divorce, on the grounds of cruelty and habitual drunkenness. The cause was tried by the court, and after hearing the testimony of the plaintiff, and her witnesses, counsel for defendant, without introducing any testimony on behalf of the defendant, moved the court to dismiss the action on the ground that the evidence was insufficient to entitle the plaintiff to the relief demanded.
