Plaintiff, Earl Noland, was a contractor engaged in building bridges, culverts and the like, and had obtained contracts in Chase county. He issued checks on the Union State Bank of Arkansas City, which were not honored by the bank, but were protested by it. Two parties to whom checks were given caused his arrest on two no-fund checks. He was taken to Chase county, where the checks were paid by his bondsmen, including the costs of the criminal proceedings. Under the law the prosecutions were abated, and he was released.
